Workers' compensation

Workers' compensation is a vital component of business insurance that offers essential benefits to employees who sustain injuries while performing their job duties.

In many states, obtaining workers' compensation coverage is a mandatory requirement for small business owners. By having workers' compensation insurance in place, you can safeguard your business from potential legal disputes and costly lawsuits.

Additionally, this coverage ensures that your employees receive the necessary compensation mandated by the state, including coverage for lost wages and medical expenses. Certificate of insurance

A certificate of insurance is a document that shows proof of your insurance coverage. This document will summarize all the benefits your insurance policy includes. The COI lists all the important information related to the policy, including:

  • PEO name
  • Company name
  • Name of insurer
  • Types of insurance coverage
  • Limits of insurance coverage
  • Date certificate was produced
  • Effective dates
  • Expiration dates
  • Policy numbers

It’s important to note that your COI and your actual insurance policy are not the same. While the COI serves as evidence of insurance coverage, it does not confer any of the benefits outlined in your policy. Therefore, it is imperative for your company to maintain an active insurance policy, regardless of the presence of a COI.

In today's business landscape, having insurance coverage is crucial for establishing trust and credibility with clients and customers. It is a common requirement for individuals and companies entering into partnerships with other businesses, including vendors, distributors, customers, and contractors, to provide proof of insurance before commencing collaboration. This practice ensures that all parties involved are protected and mitigates potential risks.

By demonstrating a commitment to maintaining adequate insurance coverage, businesses can instill confidence in their partners and foster strong, secure relationships.

The self-service Marsh Web Portal is available 24/7 to obtain your certificate of insurance as an ADP client. Ask the person requesting the COI what the minimums and limits of coverage should be. Please note that it is important to request your COI ahead of time before you plan to start working with the vendor, contractor, or customer.

The self-service Marsh Web Portal lets you create certificates when you need them without waiting.  You’ll download your COI so you can email it to the Certificate Holder. You can also print certificates from the Web Portal.

If your PDF doesn’t open, you may have a pop-up blocker turned on. You’ll need to disable this pop-up blocker to open and download your PDF. If you’re still having difficulties, please contact Customer Service.

Tip: Chrome is the best browser for accessing your Customer Portal. Safari is not a preferred browser.

If you happen to encounter issues accessing our portal, do not panic! It is best in this scenario to reach out to Customer Service.

We will be able to both assist you in diagnosing and reporting your issues when needed and process any document requests that you may have in the meantime.

In applicable states, waivers of subrogation can easily be included with your COI.

In the Marsh portal, select yes to the question “Are you required to provide a waiver of subrogation?"

To request an NOC endorsement, select yes to the question "Do you require special endorsements or contractual language", and select yes to the question "Does the certificate holder require a notice of cancellation?"

You will need to provide the # of days’ advanced notice of cancellation required. NOCs are typically written for 30 days.Please note that NOCs do NOT apply in the following states: AZ, FL, NJ, NC, ND, OH, VT, WA, WI, and WY.

If you receive a request for a cancellation notice, we are unable to complete this portion of the request, as the state included in their request does not honor the NOC endorsement.

You can’t add an additional insured to a workers’ compensation policy. Your policy only covers your direct employees. “Additional insured” status is a term used often for general liability insurance. It denotes that you’re offering your general liability insurance policy benefits to another party you’re engaging in business with, and is commonly used (and in some cases, contractually required) by businesses.

We can add an alternate employer endorsement to your policy. Please contact Customer Service to have this added. To request this, we will need the following information to be included in your request:

  • Alternate employer name to appear on the certificate?
  • What type of relationship does your company have to the certificate holder? 
  • Project location? 
  • Expected length of project? 
  • Type of work being performed? 
  • Number of employees working on the project? 
  • What are the states of payroll for those employees? 
  • Are subcontractors being used?

We may be able to add the additional states to your policy. AIG has two policy forms—not all states can be included on the same form. Please contact Customer Service to assist you with this request.

We are able to obtain these for you from ADP. Please contact Customer Service and one of our representatives will refer your request to ADP on your behalf.

Classification codes, or ‘class codes’ are the alphanumeric codes associated with the exposures which are a part of the business you conduct. You may request a redacted copy of your classification codes from the Service Center.

As you are under a PEO agreement with ADP, you are not privy to the information used for calculating premiums as you do not pay a direct premium. Your worker’s compensation coverage is included as a part of your PEO relationship with ADP.

If you have additional questions, you should contact your Human Resources Business Partner (HRBP) or your Risk Management team at ADP.

An experience modifier rating, also known as an experience modification factor or EMR, is a key component of the workers' compensation insurance premium calculation. It is a numerical representation of a company's past workers' compensation claims experience compared to other companies in the same industry.

Certificate review

There may be a few reasons you cannot to see a certificate. It could be the result of inactive or expired cert information, for example:

  • If there is an inactive policy
  • If you requested to not have it regenerated at the renewal

Renewal certificates that were not selected or available through the review process can be requested through the web portal. To request a certificate, click on the "Request a Document" link at the top-right corner of the Certificate Review page.

Removing certificates from the portal was available during the March 1-17, 2023 review period. There were email communications previously sent out regarding this process. If you missed the opportunity to act on these notifications, you will be able to remove certificates from the portal during the next review period for the next policy period renewal.

Certificates will not be automatically uploaded to vendor sites. Please contact your 3rd party vendor for instructions on initiating this request. Once we receive that information from the vendor we will process on our end. As a best practice, these documents should be initiated through your 3rd party vendors prior to the 7/1/2023 renewal. 

There are a few different reasons there could be a delay, we have outlined them below. 

  • Requests for a minimum premium policy: If you select that you need ADP to not be listed on your certificate, this will route to our service center for review, approval and issuance of a Minimum Premium Policy
  • Requests to add a new registered DBA (doing business as): These requests will be routed to our service center to work directly with ADP for approval
  • Requests for description of operations language (special language requests) that include General Liability insurance descriptions for the Workers' Compensation policy: This includes phrases like “additional insured” and “primary and non-contributory” as these do not apply to workers compensation
  • Requests for special endorsement that require approval through the carrier or ADP. i.e. USL&H, defense based acts, Jones Act, Continental shelf, foreign travel, notice of cancellation endorsement
  • Bulk requests without file attachments or in the incorrect format: The template for these requests can be accessed through the portal

The system defaults to renew your certificate unless you specified not to renew. Please allow 3-4 business days for your renewal certificate to be available through the portal.  If you need your renewal certificate prior to this time, please go to Request a Document to generate the certificate for your next policy period. 

If your new business name and/or address are not reflected through the portal, you can requests those updates via your ADP HR Business Partner. 

  • You may download an individual document or multiple documents at a time from the portal
  • You may request to email your documents from the Document History option on the portal
  • You may request to have your documents physically mailed from the Document History option on the portal

This verbiage is included in the waiver documentation as part of the standard form provided by the carrier of the coverage and approved by the state. This does not apply to you as you participate in the ADP PEO program and are not assessed premium for your ADP workers compensation coverage.

Terms & definitions

Endorsement that prohibits an insurance carrier from recovering the money they paid on a claim from a negligent third party.

Extends workers compensation coverage to other companies with whom the primary insured may do business with for specific projects.

Modifies an insurance policy to provide notice of cancellation beyond that stipulated in the policy.

USL&H (United States Longshore and Harbor) is a federal coverage that applies to maritime employees who work on or over navigable waters in or adjacent to the United States.

Federal law that gives seamen who were injured in the course of their employment the right to sue their employer for personal injury damages.

Extends the benefits of the Longshore and Harbor Workers' Compensation Act (LHWCA) to workers injured or killed upon fixed structures (e.g., oil well platforms) that are permanently attached to the outer continental shelf for the purpose of natural resource exploration or development.

The Defense Base Act provides workers' compensation protection to civilian employees working outside the United States on U.S. military bases or under a contract with the U.S. government for public works or for national defense.
