Errors & Omissions incident checklist

An E&O claim can be a confusing and frustrating process. We have outlined a list of helpful dos and don'ts to
guide you should you experience a claims incident.

DO:

  • Do complete the claim report that is in your Handbook and promptly submit as instructed on the form; or contact a Marsh representative for assistance.
  • Do gather and organize all pertinent records related to the claim.
  • Do record all information known about the incident surrounding the claim.
  • Do cooperate with the insurance carrier.
  • Do comply with all policy conditions and requirements.

DO NOT:

  • Do not overreact to the claim.
  • Do not, under any circumstances, alter the client's file as it relates to the charges.
  • Do not discuss the claim with anyone other than the claims representative, legal counsel or any other member of the office directly involved in the claim.
  • Do not admit to wrongdoing or offer to make any payments.
  • Do not provide any written or recorded statement without your insurance carrier's legal counsel or WFGIA/TFA legal counsel present.
  • Do not allow inspection, copying, or removal of client files and records without consulting with WFGIA/TFA legal counsel managing the claim.
  • Do not attempt to manage the claim on your own.

WHEN TO REPORT A CLAIM

 

  • When you are served an actual lawsuit, summons, notice to take depositions or to produce documents, or other legal action.
  • When you are served with or asked to respond to a complaint or any other federal, state, or local legal proceeding.
  • When you are served with a subpoena.
  • When you are threatened with litigation or legal action and/or received a demand for money or services, either verbally or in writing.
  • When you become aware of any proceeding, event or development that has resulted in or could in the future result in the establishment of a claim against you. 

WHERE TO REPORT A CLAIM

As soon as you are aware of a claim or potential claim, complete the claim report that is in your Handbook and promptly submit it as instructed on the form; or contact a Marsh representative for assistance.

The policy for which you are applying is issued by a purchasing group. The purchasing group may not be subject to all of the insurance laws and regulations of your state of domicile. State insurance insolvency guaranty funds may not be available for purchasing groups.
